Step 4. Consider Forming a Christian Ministry of Your Own in California
Some feel called to go beyond the structure of an existing church and found their own ministry. This takes a special type of leader. You know if this is your calling, what God wants you to do, or not.
But before you can begin down this unique spiritual journey you need to take care of a few important items of business at the state and federal levels.
At the state-level you’ll begin by working with the California Secretary of State:
- Choose a name for your church. You can search the California Secretary of State to make sure you aren’t duplicating a name that’s already taken.
- Draft Articles of Incorporation for a nonprofit religious corporation and submit it to the Secretary of State.
Next, you’ll work with the IRS to register your church as a federal 501(c)(3) nonprofit:
- Apply for an Employer Identification Number (EIN) using an SS-4 Form.
- Draft Articles of Incorporation that describe your church’s governance and management system. You also need to draft a Declaration of Trust. The IRS provides examples of what must be included on these documents.
- Submit a Form 1023 to the IRS ($275 fee); this is your official application for non-profit 501(c)(3) status.
Once you’ve completed the process with the IRS there are still a few things you need to do at the state-level in California:
- If your church is going to be a charitable institution, you must register it with the California Attorney General using Form CT-1 ($50 fee).
- Submit a Statement of Incorporation to the Secretary of State using online Form SI-100
- Finally, to obtain state income tax exemption status from California you’ll need to submit an exemption request, Form 3500A, to the California Franchise Tax Board at the address provided on the form.
And that’s it. Once the paperwork is out of the way you can focus on the exciting spiritual path that God has laid out before you, take up the cross, and pursue your calling to lead your own ministry.
